Licensing Professional schools are public law corporations made up of people with common interests which duties are given social benefit. Apor The existence of private interests of professionals does not justify the use of this figure. Only the relevant public interests may be subject to the activities of professional associations. Thus only professions that require certification and meet important social functions can create a professional body. In the case of journalism, the licensing is not mandatory for the exercise of the profession. Thus, the ethical rules laid down in various codes mandate the exercise of the profession in cautionary terms, but without the possibility of sanctions for breach institutionalized. They are not coercive rules (understood from the law).The sanctions that can confront a reporter who fails to comply with professional ethical standards are social: prestige, credibility loss, excluding the group ... The lack of membership and adoption of a code of conduct leads to the free exercise of journalists, acting under the dictates of their own morality. The regulation of the profession would eliminate situations of social conflict, as is the case of misconduct to the incorrectuse of the right of "free speech", "secrecy in relation to the sources used" ... The existence of several journalistic ethics codes suggests the lack of unanimity of opinion when it comes to produce it. While it is true that all serve the same issues, so do not do it the same way. This is an example of the inability to find a unique and valid solution that satisfies both the journalists and society.Journalism, and therefore their codes of ethics, has a special difficulty in confirming a series of rules to follow, as journalists, to do their job, are doing social work. Furthermore, there are commonalities that recall is possible to establish universal standards. For example, all codes of practice defending the right to truthful information and the necessary correction of misinformation, while condemning the libel. Therefore considered basic principles of journalism are gathered and unanimously in the various codes of the profession. Liberty is the privileged context in which they emerge and develop more effectively the social and professional life.However, since that would be unthinkable to reconcile the exercise of individual freedom and extreme with the requirements of the common good or the very viability of social life, there must be some forum to organize, encourage and limit the exercise, by enacting of laws which mark and ensure the rules of the game, a code of ethics. In this respect, there appears no dispute among professionals. Neither seems to be controversial creation of professional associations in the field of journalism, to ensure ethical and professional dignity and respect for the rights of individuals and exercising the power in the order disciplinary professional and college ( Act professional). But very different is the issue of compulsory licensing. At present, the exercise of journalism in Spain does not require compulsory licensing, as indicated above.However, there is the initiative to enact a "Statute of professional journalism" was presented at the Congress of Deputies in 2004 and still in progress. This is intended, as recognized in its preamble, that of serving the right of citizens to be informed, ensuring the independence of reporting. In Article 2 of this Statute shall be entered fully into the controversy that we are analyzing: The condition of journalist is cred with the corresponding card. Among the advantages of a system of professional practice by passing the compulsory usually mentioned first, the avoidance of intrusion.
